Contest to fine 10027/185
I have been issued a summons for the above mentioned notice number on the 11 February 2009, dated the 12 December 2008 (2 months to deliver?) Summons Number JV/0027798/08
I have to this date not received the first notice.
The car WMRGP is in the name of Avis rent a car, so I am assuming this is the reason for not receiving any previous notice.
As per the summons, the offence took place on the 13 July 2008 at 06:26
This cannot be possible as we were not in the vicinity of Baragwaneth at this time, this was a Sunday morning, and we live in Benoni, and did not have our 5 month old baby out at that time of the morning, during winter.
I did however return the car on the same date (13 July 2008) to Avis at OR Tambo Intl, at 16:40 (as per the attached rental agreement) so I am assuming the offence happened at 18:26, and not 06:26. It seems Avis did not correct their system details once the car was returned, as it was not in my possession at 18:26
I called (011) 836 to confirm the time of the offence as the Payfine website also stipulates 06:26, and I was told that it could have been either am or pm, the consultant was not sure of how times are printed on the fines.
Furthermore, I am unable to view a photograph on the Payfine website as it is not available, is there a reason for this?
I have contacted Avis at OR Tambo Intl, and am still waiting for a response from their fines department. I would like to view the photograph.
I am refusing to make payment, as this offence was not committed by me; please take the matter up with Avis rent a car at OR Tambo Intl
