Assignment Two- Explain the basis for hotel's liability for not honoring a confirmed reservation
Hotels are generally liable for damages if they do not honor a confirmed reservation by a guest; this is a result of overbooking. However, if this occurs hotels usually "walk the guest". This is when the confirmed guest is taken to another hotel usually offering the same amenities. In addition, this "walked guest(s)" will be obligated to pay the same rate that they were going to pay initially. In some cases the initial hotel will provide transportation for the guest to the other hotel.
Assignment Three- Identify issues associated with overbooking
Overbooking is defined as the sale of access to a service which exceeds the capacity of the service. The issues that are associated with overbooking include;
* Bad reputation
* "Walking Guest"
* Misnomer Crime
The book definition states, "It implies a deliberate and knowing overfilling of a hotel, creating a situation where the hotel knows, or should know that it will have no rooms left for some of its guest. Hotels could be charged with fraud if it knowingly took reservations with no available rooms.
Assignment Four- What are the major items that must be included in a contract between a hotel and a group?
The major details that need to be denoted between a hotel and a group in a contract are as follows:
* Date
* Flat Rate Fee (Rooms)
* Number of rooms
* Tentative schedule if meeting room is desired
* Pre-registration procedures
* Luggage handling
* Transportation agreements
* Federal, state, and local taxes if applicable
* Procedures for speedy-check outs
* Protection Clause
o Impossibility of performance by reasons of labor strikes, civil disorder, etc
o Cancellation Clause
