Several years ago the Port of Orcas island whom manage the Eastsound Airport a small general aviation airport of limited but friendly use and significance undertook to please the Federal aviation administration by surrounding the airport proper, including neighboring property holders whom own a right of access in the airport by deeded easement. These neighboring property holders and deed holders
Signed over an easement over and across their private lands to the Port of orcas and to the response and demands of the Federal Aviation administration. This easement was for the effect to erect a perimeter wildlife fence such that no longer would there be a continuing possibility of accident created by wildlife on the runway. At the time of the transaction between the Port of Orcas and the property holders there had been ongoing discussion of upcoming demands concerning rights of access to the runway. The neighboring property lands hold permanent deeded access rights to the Airport proper and such is the subject of formal legal terms found in the deeds of these neighboring properties. When the transaction took place as mentioned above at the insistence of the FAA all men had good reason to believe as in the effects of gain on the part of neighboring properties giving up a strip of land for the cause of erecting a wildlife fence upon neighboring properties would bring to a close the through the fence access concern, such was published in the local news. I'm fact full enumeration consideration was only found in the complete indemnity towards neighboring properties concerning this fence.
The erecting of a fence takes place surrounding the parcels of included access to the airport. Today in 2010 neighboring properties are told they are once again the subjects of "through the Fence"
We property owners understand that the Federal Aviation Administration has inscribed our whole area as a nonconforming airport because we are supposedly "through the fence airport users" and continue to use the airport without paying fees such as tenants.
We find that the FAA has not only allowed a potential problem to proliferate but indeed to extend further the liability of this little Port to hold liabilities of indemnity towards neighboring property owners.
And Now, The FAA takes to moving away from providing further support to this Airport. By finding our little airport noncompliant.
